TOWN OF LIMA REZONING APPLICATION
A motion was made by Cluff, and seconded by Vahue to adopt the following:
WHEREAS, the Town of Lima has received an application for rezoning a fifty three plus acre parcel of land on the East side of NYS Route 15A, and
WHEREAS, the applicant for this parcel is the Wal-Mart Corporation who wishes to build a 165,000 square foot commercial "big box" and
WHEREAS, the Town Boards of the Town of Lima & the Town of Mendon & the Trustees of the Village of Lima cooperatively submitted a joint application for funding under the "Quality Communities Grant" in December of 2005, and
WHEREAS, the "Project Summary" of this application states "The Project will address shared interest...to preserve open space, retain farmland for contined agricultural production, preserve natural features & historic resources, protect scenic views & corridors, revitalize downtown business districts, & to promote the development of recreational trails" and,
WHEREAS, the Grant Application specifically states the following recommendations in in Developmentment Regulation for the Town of Lima"
- "Direct commercial development in the Town outside the Village to a mixed-use area along the west west side of Rte 15A north. New ventues should be located in compact settings with new access roads consisten with transportation designs in that area.
- In the Town outside the Village, require commercial design to be visually attractive in a manner that harmonizes with surrounding landscapes and buildings. Develop parking to the side or rear, instead of in the front, of all new structures. Businesses providing services and goods to the local community are preferable to "big box" retail that would not be compatible with the scale of other developments in the town.
- Encourage a mixed use planning approach for the Route 15A north corridor to best blend compatible uses. Current use is commercial and light industrail on the west side, redidentail on the east side.", and
WHEREAS, the application by the Wal-Mart Corporation is specifically contrary to the stated development goals in the Quality Communities Grant application due to the proximity of this parcel to the Town of Mendon and the impact on traffic, economic development and quality of life in our respective communities, and
WHEREAS, the Town of Mendon may not have an opportunity to formally respond in the future.
NOW THEREFORE BE IT RESOLVED that the Mendon Town Board formally requests that the Lima Town Board deny the Wal-Mart Application.
BE IT FURTHER RESOLVED that this Board requests that the Lima Town Board keeps us informed regarding the status of this application.
